Fund Use Attestation

This Fund Use Attestation ("Attestation") is completed by an authorized representative of the applying organization in connection with the Organization Account application on the Xerish Platform. By submitting an application and checking the attestation box, the authorized representative certifies the following on behalf of the organization, under penalty of perjury. This electronic attestation constitutes the legal equivalent of a handwritten signature.

1. The Organization is a legally recognized entity duly organized under the laws of its state of formation and in good standing with all applicable regulatory authorities.
2. The Organization is authorized to solicit charitable contributions in all jurisdictions where solicitations made through the Xerish Platform may be received, or will obtain all required registrations and licenses before using the Platform to solicit in any such jurisdiction.
3. The Organization acknowledges that Xerish does not register as a charitable solicitation platform on the Organization's behalf and that compliance with all charitable solicitation laws is the Organization's sole responsibility.
4. The Organization will immediately notify Xerish in writing if its authorization to solicit charitable contributions is suspended, revoked, or challenged in any jurisdiction.

1. The Organization is either: (a) recognized as tax-exempt under Section 501(c)(3) of the Internal Revenue Code, and contributions to the Organization are deductible to donors as charitable contributions to the extent provided by law; or (b) a religious organization that qualifies under Section 501(c)(3) without formal IRS recognition pursuant to applicable law.
2. The Organization's tax-exempt status is currently in good standing and has not been revoked, suspended, or subjected to pending adverse action by the IRS or any state tax authority.
3. The Organization will notify Xerish immediately in writing if its tax-exempt status is revoked, suspended, or materially threatened.
4. The Organization will comply with all IRS requirements applicable to 501(c)(3) organizations, including maintaining adequate records, filing required returns, and issuing written acknowledgments for gifts of $250 or more.

1. One hundred percent (100%) of all funds received through the Xerish Platform will be used exclusively for the charitable purposes described in the Organization's Platform profile, campaign descriptions, and posts.
2. No portion of funds will be used for: (a) private inurement to any individual; (b) excessive compensation to officers, directors, or employees; (c) political campaign contributions or substantial lobbying inconsistent with 501(c)(3) status; or (d) any purpose that would jeopardize tax-exempt status.
3. Impact metrics and program descriptions published on the Platform reflect the Organization's genuine, good-faith estimate of social outcomes generated by donated funds, and the Organization maintains documentation supporting such claims.
4. All campaign-specific fund use will be reported to Xerish within 180 days of a campaign's closing through a completion post or written update describing how funds were applied.

1. All information submitted in the organization application — including the organization's legal name, EIN, address, contact information, mission description, and supporting documentation — is accurate, current, and complete as of the date of submission.
2. The Organization will promptly update its Platform profile and notify Xerish if any attested information changes materially.
3. The Organization has not been the subject of any government investigation, enforcement action, or legal proceeding relating to charitable solicitation fraud, misuse of charitable funds, or tax fraud in the past five (5) years, or has disclosed any such matters to Xerish in writing.

1. Any material misrepresentation in this Attestation or in the Organization's use of the Platform constitutes a material breach of the Organization Partner Agreement and may result in immediate suspension or termination of the Organization's Platform account.
2. Xerish reserves the right to refer evidence of fraud, misuse of charitable funds, or other illegal activity to appropriate law enforcement and regulatory authorities.
3. Xerish may share information about the Organization's removal from the Platform with other Platform participants and with relevant regulatory authorities where required by law or in the public interest.
4. The authorized representative signing this Attestation has read and understood all provisions herein and has legal authority to bind the Organization.

By submitting an Organization Application on the Xerish Platform and checking the attestation box, the authorized representative certifies, under penalty of perjury, that the foregoing statements are true and correct to the best of their knowledge and belief. This electronic attestation constitutes the legal equivalent of a handwritten signature and is binding upon the Organization and its successors.
